1. Acceptance of Terms By paying the attached PayPal invoice for the Data Recovery Diagnosis Fee, you (the "Client") explicitly agree to be bound by the terms and conditions set forth in this Agreement with Seattle Data Recovery (the "Company"). You acknowledge that payment of this invoice serves as your electronic signature and constitutes a binding legal contract.

2. Diagnosis Fee and Scope The Client agrees to pay a non-refundable Diagnosis Fee of $199.00 per device. This fee covers the initial evaluation of the media to determine the extent of damage and the feasibility of data recovery.

  • Standard Timeline: The typical diagnosis process is estimated to take three (3) business days from the time the device is received.

  • Clean Room Inspection: This diagnosis fee includes a specific Clean Room inspection if deemed necessary by the Company technicians.

3. Clean Room Protocol and Extended Timeline If the initial evaluation determines that the device requires Clean Room service:

  • Extended Timeline: The Client acknowledges that shifting the device to the Clean Room may extend the diagnosis and recovery timeline to approximately two (2) weeks.

  • Clean Room Authorization: By paying this invoice, the Client acknowledges that if the device must be sent to the Clean Room, the complexity of the recovery increases.

4. Binding Agreement on Recovery Pricing The Client acknowledges that Seattle Data Recovery maintains transparent pricing, publicly available at: https://seattledatarecovery.com/data-recovery/pricing/

  • Irrevocable Authorization: Once the Client authorizes the Company to proceed with a Clean Room recovery (either verbally, via email, or by creating this initial work order if pre-authorized), the Client may not rescind or "back out" of the recovery service.

  • Due to the irreversible nature of the labor and parts usage in a Clean Room environment, the Client agrees to be bound by the pricing schedule listed on the Company website referenced above once the Clean Room process is initiated.

5. Limitation of Liability The Client acknowledges that data recovery is inherently risky and that the media provided is already damaged. Seattle Data Recovery shall not be liable for any further damage to the media or for the inability to recover data. The Client warrants that they are the legal owner of the device or have the legal right to request data recovery services.

6. Unclaimed Property Any property left with Seattle Data Recovery for more than 30 days after the service is completed or a notification is sent may be disposed of or recycled in accordance with Washington State law.

7. Governing Law and Jurisdiction This Agreement shall be governed by and construed in accordance with the laws of the State of Washington. The Client agrees that any legal action or proceeding regarding this Agreement shall be brought exclusively in the courts located within Washington State.

    "Please find the invoice for the Data Recovery Diagnosis attached. Please note that by paying this invoice, you agree to the Terms of Service regarding timelines and our Clean Room binding pricing policy."

  2. In the "Terms and Conditions" field (on the PayPal invoice creation screen):

    "Payment of this invoice constitutes acceptance of the Data Recovery Agreement. Diagnosis is $199/device (3 business days). Clean Room service extends timeline to 2 weeks. Once Clean Room service is authorized, the client is bound to the pricing listed at https://seattledatarecovery.com/data-recovery/pricing/ and may not cancel. Jurisdiction: Washington State."

Critical Notice: Physical Damage & Hardware Policy

Please be advised that ANY damage that is physical or mechanical in nature requires additional parts and labor.
The baseline mechanical recovery rate covers our cleanroom environment entry, laboratory equipment allocation, and initial micro-engineering setup. Because physical failures require sourcing exact matching donor drives from our global component pipeline to swap out broken read/write head assemblies, seized spindles, or damaged electronics, all components, replacement donor hardware, and extended mechanical bench labor will be billed as additional standalone costs following your diagnosis.
